These Terms of Service (“Terms”) govern your use of FairTaxAppeal.com and any report or materials provided by Fair Tax Appeal, operated by Fair Tax Appeal LLC (“Fair Tax Appeal,” “we,” “us”). By using the site or ordering a report, you agree to these Terms. If you do not agree, do not use the site or order a report.

1. What We Provide
Fair Tax Appeal prepares a flat-fee, informational assessment-review report that may include an assessment and TRIM summary, a comparable-sales table with valuation notes, county filing notes, an evidence-exchange checklist, and an editable homeowner statement. The report is informational and supports a self-filed appeal.

2. What We Do Not Provide
We do not provide legal, tax, accounting, or appraisal services. We do not file petitions, complete official forms for submission, represent you, appear at hearings, or contact any government office on your behalf. No attorney-client, agent, fiduciary, or other professional relationship is created by your use of the site or our reports.

3. Eligibility
You must be at least 18 years old and the owner of the property, or authorized to act for the owner, to order a report. You agree to provide accurate and complete information.

4. Your Responsibilities
You are responsible for reviewing the report, verifying all facts against your own records and official county sources, confirming current deadlines, fees, forms, and rules, completing and signing any required forms, filing your own petition on time, paying any filing fee, making the required partial tax payment before delinquency, exchanging evidence on schedule, and attending any hearing.

5. No Guarantee
We do not guarantee any reduction, refund, savings, or appeal outcome. Any examples, ranges, or sample figures are illustrative and are not predictions or promises of any result.

6. Fees and Payment
The price of a report is the flat fee shown at checkout. Payments are processed by our third-party payment processor (Stripe). You are responsible for any taxes that apply to your purchase. County filing fees, if any, are separate, are paid by you directly to the county, and are not included in our fee.

7. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

8. License and Intellectual Property
The report and all site content are owned by Fair Tax Appeal or its licensors. When you purchase a report, we grant you a limited, personal, non-transferable license to use that report to prepare and pursue your own property tax appeal. You may not resell, redistribute, sublicense, or publish the report or site content, and you may not copy or file any sample materials marked as illustrative.

9. Acceptable Use
You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with its operation, scraping content, or using the site or reports for any unlawful purpose or to provide appeal services to third parties.

10. Third-Party Services and Links
We use third-party services (such as payment processing, hosting, and email) and may link to government and other third-party sites. We are not responsible for the content, policies, or practices of third parties.

11. Disclaimer of Warranties
The site and reports are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant that information is current, complete, or error-free, and county rules can change.

12. Limitation of Liability
To the fullest extent permitted by law, Fair Tax Appeal and its owners and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost taxes, penalties, missed deadlines, denied petitions, or lost savings. Our total liability for any claim relating to the site or a report will not exceed the amount you paid for that report.

13. Indemnification
You agree to indemnify and hold harmless Fair Tax Appeal from claims arising out of your use of the site or a report, your filings, or your violation of these Terms.

14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state courts located in Collier County, Florida, or, if federal jurisdiction applies, in the United States District Court for the Middle District of Florida, Fort Myers Division, unless applicable consumer law requires otherwise.

15. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date will reflect the change. Your continued use after a change means you accept the updated Terms.
